Vial Fotheringham is a full-service homeowner association law firm and resource team, providing education, analysis, and advocacy on behalf of associations. With 20 Lawyers and four offices in Oregon, Southwest Washington, Idaho and Utah, we are committed to proactive assistance; we offer comprehensive education, training, and answers to HOA questions, in order to help associations navigate community life.

Vial Fotheringham serves as general counsel for hundreds of homeowner and condominium associations across the Northwest and Intermountain West. We represent high-rise condominium homes, residential subdivisions, mixed-use associations, and commercial HOAs. As general counsel we:
• Interpret and amend governing documents
• Collect past-due assessments and fines (without using the association's funds)
• Enforce governing documents, rules, and regulations
• Draft resolutions
• Represent associations in all types of HOA litigation, with special emphasis on construction defects and insurance litigation
• Review contracts
• Run all types of association meetings
• Assist associations through the process of turnover from developer control to owner control
• Comply with state and federal law, including fair housing issues, etc.
• Offer legal advice and answers to questions regarding any general HOA matter

Tim has practiced law in Oregon since 1987 and in Washington since 1988, primarily representing companies and individuals in business and real estate litigation, homeowner association law, and creditor representation. He has appeared in the state courts throughout both of those states, the U.S. District Courts and U.S. Bankruptcy Courts for the District of Oregon and for the Eastern and Western Districts of Washington, and the Bankruptcy Appellate Panel for the Ninth Circuit. Most of Tim’s legal career has been in private practice, although he did serve as in-house real estate counsel and as manager of the title group for a financial services company. Prior to becoming an attorney, Tim spent ten years in the banking industry for a local Oregon bank.
